Email Marketing Software: Enabler

You agree and undertake that you will not post or transmit to, through or using Enabler any Enabler Materials, statement, material or communication that:

• is unlawful or which gives rise to civil or criminal liability;
• is technically harmful such as computer viruses, worms, logic bombs or other malicious software or harmful data;
• is defamatory, libellous, untrue, discriminatory, obscene, inflammatory or racist;
• breaches the acceptable use, or anti spam policy of the recipients email provider.

You agree and undertake to ensure that all email addresses and lists used by you in Enabler have been collected legitimately and are used in accordance with the EC's Directive on Privacy and Electronic Communications and the US CAN-SPAM Act.

You agree to indemnify and hold harmless Pancentric Ltd against all liability it may have in respect of and arising out of your use of Enabler and its creation, use and distribution of Enabler Materials.
